I understand that as a condition to participating in personal training and/or group training activities (the “Activity”) being offered to me by Explicit Fitness (the “Company”), I must and do agree to each of the following:

I understand and agree that there are dangers and risks inherent in participating in the Activity. Such dangers and risks may include but are not limited to personal injuries, including bodily injuries, both external and internal, injuries from objects located on Company premises, injuries caused by personal trainers and/or coaches, and injuries from coming into contact with persons and/or objects located on Company premises. Injuries could include, but are not limited to death resulting from the failure of equipment, or poor judgment of the use of any equipment, up to and including cuts, scratches, bruising and tears to muscles and/or other body parts.

I understand and agree that my participation in the Activity is completely voluntary. I understand and agree that I have no obligation to participate in any part of the Activity, but choose to do so completely at my own risk. I understand and agree that I am assuming full responsibility for any and all associated risks of injury (including catastrophic injury or death), property damage, other violation of the rights of another, inconveniences, and/or irregularities which may result from my or others’ actions or inactions, whether or not negligent or intentionally caused, and whether or not foreseeable by the Company.

I hereby voluntarily release the Company and its officers, agents, and employees from any liability resulting from or arising out of my participation in the Activity to the fullest extent allowable under applicable law. This release may have the effect of releasing, discharging, waiving, and forever relinquishing any and all actions or causes of action that I may have or have had, whether past, present, or future, whether known or unknown, and whether anticipated or unanticipated by me, arising out of my participation in the Activity, or any portion of the Activity. This release constitutes a complete release, discharge, and waiver of any claims and causes of action I may have against the Company and its officers, agents, and employees.

I understand that and agree that this release will be binding on me, my spouse, my heirs, my personal representatives, my assigns, my children and guardian ad litem for my children.

I have carefully read the agreement and fully understand its contents. I am aware that I am releasing certain legal rights that I otherwise may have and I enter into this contract on behalf of myself and/or my family of my own free will.

I certify that I am physically fit, and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in the Activity.

THIS IS A RELEASE OF LIABILITY. DO NOT SIGN OR INITIAL THE RELEASE IF YOU DO NOT UNDERSTAND OR DO NOT AGREE WITH ITS TERMS.
